NEWSLETTER SERVICE POLICY
§ 1 Definitions
The terms used in this document mean:
- Regulations – these Regulations for the use of Newsletters by Service Recipients;
- Service Provider – Sieć Badawcza Łukasiewicz – Przemysłowy Instytut Automatyki i Pomiarów PIAP with its registered office at Al. Jerozolimskie 202, 02-486 Warsaw, Poland;
- Service Recipient – a natural person, a legal person, or an organizational unit without legal personality, to whom the law grants legal capacity, using the Newsletters or/and the Service based on the Regulations. A natural person can be a Service Recipient if: a) they have full legal capacity, or b) they obtain consent from a legal representative or guardian in the case of limited legal capacity, or c) they are represented by a legal representative or guardian in the case of no legal capacity;
- Website – the internet portal operated by the Service Provider in the domains to which the Service Provider has rights;
- Service – the internet service operated by the Service Provider at the web address https://testudo-project.eu/. Changing the Service address does not constitute a change of the Regulations but is notified by an announcement on the Website and in the Service and becomes effective on the date of posting this change;
- Forms – web pages on the Website allowing the Service Recipient to choose, order, and unsubscribe from receiving a specific Newsletter, and to provide the Service Provider with the personal data of the Service Recipient or/and the legal representative or guardian of a Service Recipient without legal capacity;
- Internet Tools – software and Forms made available to the Service Recipient on the Service or/and on the Website to order and use the Newsletters, as well as Activation Links and Deactivation Links provided to the Service Recipient to confirm ordering a specific Newsletter or unsubscribing from it;
- Activation Link – a hyperlink to the Service or the Website received by the Service Recipient in an email message sent to the email address provided to the Service Provider by the Service Recipient, enabling the Service Recipient to confirm ordering a specific Newsletter by activating this hyperlink;
- Deactivation Link – a hyperlink to the Service or the Website received by the Service Recipient in an email message sent to the email address provided to the Service Provider by the Service Recipient, enabling the Service Recipient to unsubscribe from a specific Newsletter by activating this hyperlink;
- Newsletter – a collection of information sent by the Service Provider to the email address provided by the Service Recipient at a specified frequency, containing informational, promotional, or/and advertising content of the Service Provider or/and other persons or/and goods or/and services offered by the Service Provider or/and other persons, particularly commercial information;
- Act – the Act of 18 July 2002 on the provision of electronic services.
§ 2 Preliminary Provisions
- These Regulations specify the rules and conditions for the use of Newsletters by Service Recipients. The Regulations have been issued based on the provisions of the Act.
- The software, interface, functional layout, graphic elements, databases, and content of the Service, as well as the graphic elements and content of the Newsletters, are subject to the proprietary copyrights or/and other intellectual property rights of the Service Provider or/and third parties and are legally protected.
- The Service Recipient is not entitled to use the content of the Newsletters for any purpose other than to acquaint themselves with their content.
- Using the Newsletters and the Service is free, except that the Service Recipient is obliged to pay remuneration to entities providing telecommunications services in the scope of Internet access and data transmission (telecommunications operators) for using Internet access or/and data transmission according to the price lists and terms of providing these services applicable to these entities.
- A list of Newsletters that the Service Recipient can order is available in the Service.
- The Service Provider may discontinue issuing a specific Newsletter, change its subject matter and/or frequency at any time.
- The Service Recipient can order any number of Newsletters from those available in the Service.
- Newsletters are sent at a frequency determined by the Service Provider for a specific Newsletter.
- These Regulations do not apply to information sent by the Service Provider to users of electronic publications licensed by these users from the Service Provider.
§ 3 Terms of Using Newsletters and Personal Data
- Ordering and unsubscribing from receiving Newsletters is done using the Internet Tools available on the Website, in the Service.
- To order and use a Newsletter, the Service Recipient should complete all the following actions: a) fill in the Newsletter order Form, check the appropriate consent fields, and send this Form to the Service Provider by clicking the “Sign Up” field below the Form; b) click the Activation Link received in an email message sent by the Service Provider to the Service Recipient.
- Confirmation of ordering a Newsletter by the Service Recipient in the manner specified in the provisions of the Regulations is simultaneously equivalent to: a) a declaration by the Service Recipient or the legal representative or guardian of a Service Recipient without legal capacity that the data provided in the Form is true; b) authorizing the Service Provider to process data regarding the Service Recipient’s use of the services and functionalities provided by the Service Provider for statistical and marketing purposes, in particular, to receive commercial information from the Service Provider and other persons; c) authorizing the Service Provider to process the personal data of the legal representative or guardian of a Service Recipient without legal capacity for purposes related to representing the Service Recipient and making declarations specified in the Regulations and in the Form.
- The Service Recipient is obliged to provide only true data in the Form. The person responsible for the truthfulness of the data entered in the Forms is solely the Service Recipient, and in the case of a Service Recipient without legal capacity, also the legal representative or guardian of such a Service Recipient.
- The Service Provider reserves the right to verify the data provided by the Service Recipient or the legal representative or guardian of a Service Recipient without legal capacity to determine whether this data is true. The Service Recipient or the legal representative or guardian of a Service Recipient without legal capacity is obliged to enable the Service Provider to verify, in particular by providing additional explanations at the request of the Service Provider.
- Providing untrue data entitles the Service Provider to cease providing services to the Service Recipient specified in the Regulations.
- The email address provided to the Service Provider by the Service Recipient will be processed by the Service Provider for the purpose of providing the Service Recipient with the Newsletter.
- The administrator of the personal data of Service Recipients and the legal representatives or guardians of Service Recipients without legal capacity within the meaning of the Act of 29 August 1997 on the protection of personal data is the Service Provider.
- Providing the Service Provider with an email address is voluntary, although it conditions the possibility of using the services specified in the Regulations.
- Service Recipients and the legal representatives or guardians of a Service Recipient without legal capacity have the right to access their data and correct it.
- Withdrawal of consent for the Service Provider to process the personal data of the Service Recipient is equivalent to resigning from the services specified in the Regulations.
- The consent for the Service Provider to process the personal data of the legal representative or guardian of a Service Recipient without legal capacity for purposes related to representing the Service Recipient and making declarations specified in the Regulations and Forms can be withdrawn at any time by the legal representative or guardian, which is equivalent to the Service Recipient’s declaration of resignation from the services specified in the Regulations.
- Expressing consent to the processing of personal data of the Service Recipient for marketing purposes means, in particular, consent to receive commercial information from the Service Provider or other persons within the Newsletters. The Service Provider is not entitled to provide the personal data of the Service Recipient to third parties mentioned in the preceding sentence without fulfilling the obligations resulting from the Regulation of 27 April 2016 2016/679 on the protection of natural persons concerning the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.
§ 4 Rights and Obligations of the Service Recipient
- The Service Provider makes every effort to ensure that the use of Newsletters is possible for Service Recipients using popular web browsers, operating systems, email programs, types of computers, and types of internet connections. However, the Service Provider does not guarantee and is not responsible for the fact that every combination of these factors will allow the use of Newsletters. Moreover, the Service software and Internet Tools may require specific configurations of the Service Recipient’s computer.
- The minimum technical requirements enabling the Service Recipient to use Newsletters, with the reservation of paragraph 1, are: Internet access, web browser, e-mail account, PDF file reader.
- The risks associated with using the Internet and the function and purpose of the software or data not being part of the content of the services specified in the Regulations, introduced by the Service Provider into the ICT system used by the Service Recipient, are provided in the Privacy Notice and Cookies Policy.
- Without the prior consent of the Service Provider, the Service Recipient cannot transfer the rights or obligations associated with using the services specified in the Regulations to a third party.
- The Service Recipient is obliged to comply with the law and the provisions of these Regulations and to use the services specified in the Regulations in a manner not violating the rights of third parties and the interests of the Service Provider.
- The Service Recipient undertakes not to act to the detriment of the Service Provider, other Service Recipients, or third parties and not to provide the Service Provider with unlawful content.
§ 5 Final Provisions
- The Service Provider reserves the right to change the provisions of the Regulations. Information about changes will be posted on the Website.
- The amended Regulations bind the Service Recipient if the Service Recipient has been properly informed about the changes and has not terminated the agreement for the provision of the services specified in the Regulations within 14 days from the date of notification of the changes.
- If the Service Recipient does not agree with the changes in the Regulations, they have the right to terminate the agreement for the provision of the services specified in the Regulations by submitting a resignation from the Newsletters in writing or electronically to the email address provided by the Service Provider.
- In matters not covered by these Regulations, the provisions of Polish law, in particular the Act of 18 July 2002 on the provision of electronic services, shall apply.
